These Terms of Use, together with the End-User License Agreement set out below (the “Terms”), form a binding agreement between you and SUMO (“we”, “us” or “our”) governing your access to and use of the SUMO mobile application and related services (the “Service”). By downloading, accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
“SUMO” or the “Service” means the SUMO application and related services provided by SUMO. “Content” means prompts, songs, lyrics, cover art and other material created, uploaded or shared through the Service. “Device code” means the anonymous identifier that represents your account. “Subscription” means a paid premium plan offered through the Service.
You must be at least 13 years old, or the higher minimum age required in your country, to use SUMO. If you are below the age of majority where you live, you confirm that your parent or legal guardian has reviewed and agreed to these Terms.
SUMO uses an anonymous, device-based account. You are responsible for all activity under your account and for keeping your device code confidential, as anyone who has it can access or delete your account. Display names and @handles must not impersonate others or infringe any rights.
Subject to these Terms and the rules of the applicable app store, SUMO grants you a personal, limited, non-exclusive, non-transferable, non-sublicensable and revocable license to install and use SUMO on devices you own or control, solely for your personal, non-commercial use unless otherwise permitted in the app.
SUMO offers an optional premium subscription with a 7-day free trial, available on a monthly or annual basis. The applicable price, billing period and trial terms are presented in the app before you confirm your purchase.
Free accounts include a limited number of generation credits, as described in the app. A premium subscription removes that limit in accordance with the plan you select. We may adjust credit allowances and plan features over time, with notice where required by law.
You agree not to use SUMO to create, upload, share or otherwise make available content that: is illegal, infringing, defamatory, harassing, hateful, or sexually explicit involving minors; violates the intellectual property, privacy or other rights of any person; or is otherwise objectionable. You further agree not to impersonate any person, misrepresent your affiliation, or scrape, overload, disrupt, circumvent the security of, or reverse-engineer the Service. We may remove content and suspend or terminate accounts that violate these Terms.
As between you and SUMO, you retain the rights you hold in the Content you create, subject to the terms of our AI provider. Because songs are public by default, you grant SUMO a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, adapt for technical purposes, stream, perform and display your Content and public profile within and in connection with the Service, including to operate, promote and improve it. You represent and warrant that you have the necessary rights to your Content and that it does not infringe or violate the rights of any third party.
Output produced through SUMO is generated automatically by third-party AI models (MusicAPI.ai) based on your input. Such output may be imperfect and may, in some cases, resemble pre-existing works. We make no representation or warranty as to the originality, accuracy, non-infringement or fitness for any purpose of AI-generated output. You are solely responsible for your use of the output, including any commercial use, and for ensuring it complies with applicable law and the terms of the AI provider.
The Service, including its software, design, user interface, trademarks and the content we provide, is owned by SUMO and its licensors and is protected by intellectual property laws. Except for the license expressly granted to you, no rights are transferred to you.
The Service relies on third-party services, including the app stores and our payment and AI providers. Your use of those services may be subject to their own terms, and we are not responsible for them.
You may stop using SUMO and delete your account at any time, in the app or at https://sumo-fm.yuracode.com/account-deletion. We may suspend or terminate your access, with or without notice, if you breach these Terms or to protect the Service or other users. Provisions that by their nature should survive termination will survive.
To the maximum extent permitted by law, the Service is provided “as is” and “as available” without warranties of any kind, whether express, implied or statutory, including any implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising from course of dealing or usage. We do not warrant that the Service will be uninterrupted, error-free or secure.
To the maximum extent permitted by law, SUMO and its suppliers will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, data, goodwill or content, arising out of or relating to your use of (or inability to use) the Service. To the extent liability cannot be excluded, our aggregate liability is limited to the greater of the amount you paid us in the 12 months before the event giving rise to the claim, or USD 50. Nothing in these Terms excludes liability that cannot be excluded under applicable law.
You agree to indemnify and hold harmless SUMO and its officers, employees and agents from any claims, damages, liabilities and expenses (including reasonable legal fees) arising out of your Content, your use of the Service, or your breach of these Terms or of any law or third-party right.
We may modify, suspend or discontinue all or part of the Service, and we may update these Terms from time to time. When we make material changes to these Terms, we will update the date above and, where appropriate, provide additional notice. Your continued use after the changes take effect constitutes acceptance.
These Terms are governed by the laws of the Republic of Türkiye, without regard to its conflict-of-law rules, except where mandatory consumer-protection law in your country of residence grants you stronger protection. Subject to such mandatory law, the courts of Türkiye will have jurisdiction over any dispute, and you agree to attempt to resolve disputes informally by contacting us first.
If you obtained SUMO from the Apple App Store, the following applies: these Terms are between you and SUMO only, and not Apple. Apple is not responsible for the Service or its content and has no obligation to furnish maintenance or support. In the event of any failure of the app to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app. Apple is not responsible for addressing any claims relating to the app, including product-liability, regulatory or intellectual-property claims. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You represent that you are not located in a country subject to a U.S. Government embargo and are not listed on any U.S. Government prohibited-parties list.
If you obtained SUMO from Google Play, your use is also subject to the Google Play Terms of Service, and Google is not a party to these Terms.
These Terms constitute the entire agreement between you and us regarding the Service and supersede any prior agreements. If any provision is held unenforceable, the remaining provisions will remain in full effect. Our failure to enforce any right is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition or sale of assets. We are not liable for any delay or failure to perform due to causes beyond our reasonable control.
